IPPP - the long-term perspective: information, due diligence and generel priciples

Abstract [en]

This article analyses some of the issues that may arise in connection with the conclusion of an IPPP project and with the initiation of the public procedure for the next contractual term. In particular, the article focuses on how to deal with the fact that the previous private partner has acquired in-depth knowledge of the enterprise, such as its cost situation and any agreements the enterprise has entered into with a third party, at the same time that the public entity, in selecting its new partner, must also conform with the general principles of transparency and equal treatment to ensure that prospective tenderers are given equal opportunities to submit competitive bids
