In 1999 a wide reform on environmental legislation took place in Sweden when the older separate legislations were gathered into a single Environmental Code (Miljöbalken). Environmental sanction charges, an administrative charge on certain minor violations investigated and decided by a supervising authority without the involvement of police and prosecutors, was introduced in the code. This report focuses on appliance and conditions for appliance of environmental sanction charges on the municipality-level in the county of Västra Götaland. A statistical review of all decisions on environmental sanction charges in the county during a four-year period showed a weak correlation between environmental sanction charges per capita and the size of the municipality. At the same time there were considerable differences between municipalities of same size and condition. A survey among the environmental inspectors at the municipalities pointed out a few reasons for these differences. Some of the smaller organizations lack resources to carry out their supervision. The inspectors also display a varying approach to environmental sanction charges. Some believe it to be a weak or even counter-productive measure and stress the importance of interaction with operators, while others consider it to be an efficient way of reaching correction. This lack of consensus in approach and practice will maintain the inequality between municipalities. A solution applicable even in the near future is additional municipal cooperations or federations, which has proved successful. Merging smaller organizations into larger ones should ensure sufficient resources, knowledge and equal exercise of authority in a larger extent.
