    Abstract [sv]

    Tvångsmedel innebär vanligtvis ett intrång i sådana grundläggande rättigheter som skyddas av Europakonventionen, där en viktig del av rättighetsskyddet är att sådana intrång kan prövas av domstol. Ett sådant krav ligger inte i linje med den svenska ordningen, enligt vilken det i hög grad är åklagare och förundersökningsledare som beslutar om tvångsmedel. I denna artikel undersöks frågan om domstolsprövning vid tvångsmedelsanvändning genom en analys av förhållandet mellan å ena sidan intern svensk rätt rörande frihetsberövande tvångsmedel och reell husrannsakan och å andra sidanEuropakonventionens skydd för rätten till frihet och till privatliv enligt artiklarna 5 och 8. Avslutningsvis diskuteras i vad mån det svenska systemet ger ett tillfredsställande rättighetsskydd.

    Under många år har kritik riktats mot bristande resultat vad avser rättsväsendets, särskilt polisens, förmåga att klara upp och lagföra brott. En nyckelaktör i det brottsutredande arbetet är förundersökningsledaren. Uppgiften att vara förundersökningsledare är fördelad mellan åklagare och polis, beroende på brottstyp och en mängd andra faktorer. Frågan om vem som leder förundersökningen - polis eller åklagare - och vem inom polisen som kan vara förundersökningsledare behandlas i denna artikel. I artikeln undersöks den rättsliga regleringen av hur fördelningen har gjorts över tid och vilka faktorer som getts betydelse för fördelningen. Undersökningen visar att praktiska och resursmässiga skäl ligger bakom en förändring där polisen leder allt fler förundersökningar, och att det finns en spretighet rörande vem inom polisen som ska vara förundersökningsledare. Samtidigt har åklagarna getts en tydligare roll som förundersökningsledare vid vissa kriminalpolitiskt prioriterade brott. Bakom dessa utvecklingslinjer ligger främst effektivitets och kvalitetskrav, medan rättssäkerhetshänsyn mer sällan varit skäl för förändringar. Avslutningsvis ställs frågan om rättssäkerheten kan behöva stärkas, genom exempelvis domstolskontroll.

    Abstract [en]

    In Sweden an oral hearing, the trial, is held as the ideal model for the criminal procedure and according to the legality principle reported crimes ought to be investigated and prosecuted. Over time high levels of reported crimes have led to an increase in pressure on the courts and other actors in the criminal process. This pressure has created new ways of dealing with reported crimes in summary procedures and to exceptions from the legality principle. Such changes have given the prosecutor a key role in deciding how cases are dealt with in the criminal process. 

    The purpose of this thesis is to examine the Swedish public prosecutor’s influence on the choice of cases that are investigated, prosecuted and tried in court during a trial. The study examines the prosecutors’ legal authority and how that authority has changed from the time that the Code of Judicial Procedure came into force in 1948 to the beginning of 2011.

    A starting point for the examination is that investigating, prosecuting and trying cases in the criminal process should be carried out in a way that is considered to be fair according to societal values, which are embedded in the legal system. Both decisions about which cases will be tried and the procedure involved in how to try them has to be performed in a way that seems to be fair. In the study the values that underlie the criminal process is examined through a model. This model assumes that the criminal process has been created and developed to satisfy different requirements, which can be separated into three main groups: the functions of the criminal process, legal principles and the main objectives of a good administration of justice. The model is used to analyze and discuss the development of the legal rules.

    The prosecutor’s authority and influence over the process has broadened and the use of summary procedures has served to place the focus on the police investigation instead of the trial. Among the objectives of a good administration of justice Speed and Cost effectiveness are considered to be more important than Security. As long as the Trust in the system is sufficient this development can continue. A conclusion from the study is that there is a need for some actor to prioritize and to do that openly. In the study the issue is raised whether it is time to question the legality principle as the main principle for the Swedish legal system.

    In 2015 the Swedish police integrated what was a highly decentralized and territorially diverse administrative organization into a new, single government agency. The goals of this encompassing administrative change were to increase the overall quality of police work, ncrease cost efficiency, create more structural flexibility and to improve the overall level of performance in Swedish policing. The achievement of higher levels of efficiency was emphasized as the core purpose of reform.

    In our presentation, we argue that the tension between political and legal first principles in Swedish policing goes beyond organizational reform. The Swedish police cannot share the monopoly of legitimate civil violence, nor the task of bringing citizens into the criminal process. Therefore, many pitfalls and contradictions pertaining to police work emanate from the inescapable cross-pressure of policy making and the Swedish legal system. We find that police practices, as opposed to organizational principles, will decide the relative success of current reform. We also argue that efficiency is a fuzzy reform concept, which must be balanced against other core democratic and legal values to gain and maintain legitimacy for the power of policing in Sweden.

    Legal limits to prioritisation in policing: challenging the impact of centralisation2020In: Policing & society, ISSN 1043-9463, E-ISSN 1477-2728, Vol. 30, no 9, p. 1061-1080Article in journal (Refereed)
    Abstract [en]

    This article illustrates, through a combination of administrative and legal perspectives, how ambitions to centralise prioritisation decisions within a police organisation can be limited by the legal rules relating to crime investigations and public order policing. As a case study, we use the centralisation of the Swedish Police, a reform intending to reduce the previously far-reaching operational independence of regional police authorities in favour of a centralised and uniform single authority. Through this case study, we analyse the interaction between the legal and institutional frameworks of policing and prosecution, including positive obligations enshrined in the European Convention on Human Rights. We conclude that legal responsibilities affecting the Swedish Police may significantly limit the possibility for managers and officers to de-prioritise many cases and public order concerns, which, in turn, may limit the ability to divert resources to other—centrally prioritised—tasks. Failure to account for such limits may cause reform ambitions to collide with legal responsibilities in day-to-day operative policing. The results indicate that research into organisational reform and police prioritisation may benefit from a more systemic analysis of the legal and institutional factors limiting institutional discretion.

    Vid juridiska institutionen, Umeå universitet, bedrivs undervisning i juridik utifrån den pedagogiska modellen problembaserat lärande (PBL). Modellen började användas år 1993 och infördes först på juristutbildningen, men används idag på de flesta kurser och program där juridiska institutionen medverkar.

     

    I denna bok medverkar flera av institutionens lärare, där de beskriver och reflekterar över olika pedagogiska frågor. I boken ges flera konkreta exempel från lärarnas undervisningserfarenhet. Boken innehåller också beskrivningar av filosofin bakom PBL och vad som kännetecknar PBL-undervisning.

    The literature on policing asserts that there has been a remarkable emphasis oninnovation in police work over the last decades. During the same time, police organizationsin several countries have been centralized to promote increased unityand response to political steering and method development. In Sweden, the policereform was motivated by a perceived correlation between uniformity in workingmethods and organizational effectiveness. From a legal perspective, innovationin police methods involves inherent questions of rule of law – ensuring legality,compatibility with human rights, and predictability for citizens. This also carriesimplications for democratic legitimacy, since the police have far-reaching powerto interfere with citizens’ spheres of interest. This article discusses issues of innovationwithin the Swedish police from a rule of law and democracy perspective.Innovation in police work is discussed on a system level through a study of thelegal framework and institutional conditions introduced with the creation of thenew police organization. Results are presented from an interview study with policemanagers on different levels within the new organization. The results suggestthat innovation in police work develops largely organically at different levels andunits within the police organization and then spread as “best practices” whichthe new Police Authority is seen as organizationally able to pick up and disseminate.Secondly, police openness to new evidence-based methods from outside theorganization is increasing. Thirdly, there is a tension between the increased abilityto create uniformity in methods and the need to adjust these methods to localconditions. Lastly, some uncertainties regarding legal accountability seem to existas new methods are developed and implemented.

    ”Men vad i…!!” Dessa ord får inleda några rader om en del av universitetets verksamhet som inte sticker ut och på ett vis handlar mer om att verka i det tysta. Universitet förknippas med forskning och utbildning, möjligtvis också samverkan. Lärosalar, korridorer och kontorsrum fyllda av studenter, lärare och forskare. Men bakom allt detta finns också en administration, eller ”stödet” som det kallas i universitetsbyråkratins budgetsammanhang. Vissa delar av administrationen är universitetsövergripande och återfinns på central nivå, medan andra finns på universitetets olika fakulteter och institutioner. På institutionsnivå kan det handla om exempelvis studievägledning och studieadministration eller om ekonomisk administration. Det finns en inneboende spänning mellan kärnuppgifterna och administrationen på så sätt att det administrativa ska stödja övriga delar av verksamheten och flyta på, utan att ”störa” alltför mycket i det dagliga arbetet. Något som illustreras av de inledande orden.

    I detta bidrag till vänboken tänker vi tillbaka på och reflekterar över vår erfarenhet av att arbeta tillsammans med Ulf, som ägnat många år och en stor del av sin tid till just administrativa frågor. Vi delar med oss av några minnen, där vår erfarenhet omfattar över 25 års arbete inom områden som bemanningsplanering, ekonomiadministration, studieadministration och studievägledning. Det här är vår berättelse.
