    Näthat är en fråga som kommit att aktualiseras alltmer under senare år. En av de rättsliga frågor som är väsentlig att belysa gällande näthat är hur det rättsliga ansvaret för att hantera och avlägsna näthat kan se ut. I artikeln kommer inledningsvis fokus att ligga på den övergripande frågan om avlägsnande av kommentarer i kommentarsfält i förhållande till yttrandefrihet och värnandet om den enskildes personliga integritet utifrån bestämmelserna i Europeiska konventionen om skydd för de mänskliga rättigheterna och de grundläggande friheterna (Europakonventionen). Därefter diskuteras svensk lagstiftning som reglerar frågor om ansvar att avlägsna kränkande innehåll på forum och liknande. Avslutningsvis analyseras frågan om den enskildes rätt att begära att uppgifter avlägsnas. Denna bredd i artikeln är nödvändig för att visa på att skyldigheterna och möjligheterna att avlägsna material kraftigt varierar beroende på sammanhanget då det framförs och på själva innehållet i materialet som sådant.

    Abstract [en]

    In recent decades the Swedish legislature has increasingly focused on the treatment of victims of crime and the information they receive. Victimology research has also shown the importance of treating victims with respect and of keeping them informed of their rights and the progress of their case throughout the process. The requirements thus set have to be met by all judicial actors, which presuppose a level of cooperation among them. Cooperation therefore constitutes one way of meeting victims' needs. In the current study these three factors; information, good treatment and cooperation, are referred to as victims’ rights.

              Studies have shown that victims experience shortcomings in the legal process regarding information and treatment. The causes of these shortcomings can be multiple, but from a legal point of view, however, the issue raises the question of whether there may be potential legal difficulties involved in incorporating adequate information and good treatment of crime victims into the judicial process. The purpose of this thesis is to study and analyse victims’ rights in the judicial process. As they are not without a legal context, these victims’ rights are analysed in relation to other legislation, principles and requirements that govern the functions of the judicial system, such as the duty of the police, prosecutors and courts to act objectively, conduct their work independently, and run an efficient legal process. The main question is whether the incorporation of victims’ rights conflicts with other rules and legal principles.   

         The study concludes, inter alia, that victims’ rights concerning the treatment of victims and coordination of the work with victims is vaguely regulated and the intended meaning of the requirements are not clear, which may lead to problems when these requirements are incorporated into the justice system. Regarding information, treatment of victims and coordination and cooperation, little guidance is given about how to incorporate this at the local level. Informational requirements are expressed more clearly in the legislation, but how and to what extent information to victims should be given can still be a matter of interpretation on the part of the actors. The existence of local differences is therefore likely, which can affect the actual support that individual victims gain access to. The legislature could choose to further clarify and elaborate upon how victims’ rights issues relate to other aspects of the judicial process, how priorities or balancing of interests should be handled as well as to reveal the underlying motives for such considerations. Such clarification could possibly increase the consistency of the incorporation of victims’ rights, and transform abstract goals into concrete actions.

    Abstract [en]

    This article draws on material gathered from Swedish tweets about the Roma population, in order to map different discourses. Based on this material, a legal analysis was made focusing on how the legal protection under the European Convention on Human Rights (ECHR) and Swedish law for such types of expression may vary depending on the wider discursive context. This article concludes that the legal protection for hateful expressions against for instance Roma, will vary depending on the discursive context. When the expression is a direct part of a political discussion, the protection of freedom of expression will be higher. However, emphasis must also be placed on the aim, value, and accuracy of the statement, even in a political context. This will increase the possibilities to legally intervene against speech that may perhaps be triggered by an ongoing political debate, but is hateful and without value to that debate.

    Abstract [en]

    This article analyses the issue of online antagonism (defined as antagonistic harassment, defamation, insults and threats online) and the positive obligations of states to counter such antagonism under the European Convention on Human Rights, from a legal and victimological perspective. The article illustrates how the necessary balancing between positive obligations to protect privacy under article 8, and the protection of freedom of speech under article 10, will result in different levels of protection depending on the victim and the type of victimisation in question. This may affect the possibilities for individual victims to gain legal redress, specifically access to the criminal justice system. By comparisons to the current Swedish legislative context, the article highlights some avenues for legislatures to enhance protection for certain groups without interfering with article 10. It also concludes that a failure to protect victims of online antagonism through criminal law may ipso facto weaken the foundations of public discourse that article 10 is supposed to protect, which should be taken into account in a balancing of the rights in question.

    Abstract [en]

    At the beginning of the 20th century, major technological changes occurred in maternity care in Europe. In connection with the introduction of good hand hygiene, advance medical equipment and use of disinfectants in the hospitals, obstetricians quickly noticed that maternal mortality decreased. This together with the rest of the medical equipment made hospital births safer. The hospitals became more attractive birth places instead of the homes. While the development from homebirth to hospital delivery went fast in Sweden, the midwives who worked in the United Kingdom and the Netherlands kept their role as primary caregiver to pregnant women by opening birth centers (freestanding clinics normally staffed by midwives offering a homely environment) and continued offering assistance with births at home, if that was the wish of the mother. Today, the United Kingdom and the Netherlands are good examples of a maternity care system with free choice where to give birth and with high patient safety. The purpose of this work is to see if Sweden can offer freedom of choice within the maternity care in accordance with Article 8 of the European Convention on Human Rights and applicable legislation. This is done by evaluating as to how maternity care is financed and the midwives’ role in the countries like the Netherlands and the United Kingdom and compared with Sweden. Today, maternity care in Sweden is severely criticized, not least by healthcare staff due to poor working environment. Pregnant women feel an uncertainty before childbirth, which has led to the government and Swedish municipalities and county councils to decide to make a major effort to improve maternity care and women's health. Within the framework of the development of the healthcare, this work suggests that a review of the freedom of choice in childbirth care would be a natural part to include in the reform.

    Nätmobbning är ett allt mer uppmärksammat och vanligt förekommande fenomen främst bland ungdomar, vilket framgår av den tidigare forskning som finns på området. Syftet med denna studie var att får en förståelse för hur ungdomar upplever och beskriver fenomenet nätmobbning som sker på sociala medier samt hur de ser på problemet och vad man kan göra åt det. Datainsamlingen för studien gjordes med hjälp av kvalitativa intervjuer med sex stycken ungdomar. I resultatet framkom att ungdomarna upplever nätmobbning som ett allvarligt problem men de menade att det är så pass vanligt förekommande att det knappast tas på allvar. Ungdomar har blivit mycket toleranta för det språk som används på internet och menade att fenomenet är en del i en social hierarki. Att komma med förslag på vad man kan göra åt problemet menade ungdomarna kan vara mycket komplext, då det finns ett flertal faktorer som påverkar nätmobbningens förekomst. En faktor som berörts mer än andra i denna studie är den möjlighet som finns till att vara anonym på internet.

    Abstract [en]

    This doctoral thesis investigates and analyzes the legal conditions under which the Swedish Social Insurance Agency may engage in cooperation with the Swedish Public Employment Service and Swedish Health Care Providers (both public and private), regarding rehabilitation, information exchange and investigation measures in individual sick leave insurance cases. It also presents an analysis of whether these legal conditions contribute to safeguarding legality and legal certainty when the Social Insurance Agency is involved in cooperation.

    Overall the thesis concludes that the legal conditions for such cooperation are good in terms of assistance regarding rehabilitation, information exchange and investigation measures. The designated assignment of the Social Insurance Agency relating to the distribution of sickness benefits is also such that any cooperation that helps the individual's rehabilitation or the investigation and assessment of entitlement to such benefits is encouraged. The legality and legal certainty in such cooperation is also found to be fundamentally safeguarded, since it follows from the principle of legality in Swedish administrative law that any measures taken by the Social Insurance Agency in cooperation with other bodies must be founded in the constitutional legal order. However, since the Social Insurance Agency's assignment pertains to the distribution of positive rights and benefits, the requirements governing how clearly stated and distinct such legal support must be are generally less stringent. This is reflected in the rules and principles identified as supporting or limiting the legal conditions for cooperation, as in many cases they lack detailed prerequisites for when they may be used or what should be done. Many of the legal rules or legal principles that limit the authority and power to freely design the possible content, aims and process practice of cooperation are also not specifically aimed at regulating such situations. Moreover, in many cases they are found in constitutional or general administrative law principles that are essentially abstract, and not usually applied by administrators in the handling of individual cases. This, in turn, affects the overall impact that the supporting factors of legality and legal certainty can have in the Social Insurance Agency's multi-party cooperation. These supporting factors include the Agency's duties to ensure independent decision-making (ideally) based on a clearly designated assignment, to comply with the legal principles of objectivity, equality before the law and foreseeability, and to respect the individual's personal integrity in multi-party cooperation.
