    Att upprätthålla rättsstatliga principer är en grundläggande uppgift för lagstiftare, myndigheter och för juristprofessionen. Rättsstaten utmanas ständigt, men utvecklingen de senaste åren har ändå varit häpnadsväckande. Kan juridisk expertis och historisk kunskap bidra till att upprätthålla rättstatlighet? Många jurister och statsvetare är upptagna med dessa frågor just nu. De historiska exemplen på inskränkningar i rättsstatliga principer och vilka konsekvenser detta medfört är många.

    Abstract [en]

    This chapter focuses on domestic violence. It turns to gay and lesbian victims of violent crimes that take place outside the domestic context. On the cultural level, legal remedies are used to uphold the 'norm' and heteronormativity can be seen as a discursive practice that pervades literature, education and legal language. It could be said that heteronormativity emphasizes the correctness of heterosexuality and traditional family forms. Anti-homosexual bias on a structural level in this context is termed heterosexism. This chapter shows the disadvantages with both gender-specific and gender-neutral legislation. A gender-specific legislation tends to present a static view, normalization, of the ideal victim in certain instances; example has been the Swedish regulation of domestic violence. Here the heterosexual woman is seen as the normal victim, therefore there is a tendency to overlook and belittle the plight of those victims of domestic abuse who are not heterosexual women

    One could argue that regulating aspects of daily life nowadays demands a lot more specialized knowledge than ever before. Technological developments obviate the need for expertise in formulating proposals for laws. When the need for new legislation is identified, the standard procedure in the Swedish legal culture is for the Government to appoint a committee of inquiry to investigate the issue and propose legal reforms. Over time there has been criticism of the quality of the work of such committees. One subject of discussion is their use of research, or rather the lack thereof, and the resulting gap between the production of knowledge and its use in committee work and in public decision making. Consequently, the use of experts and expert knowledge in the legislative process is not an unproblematic issue. The aim of this article is to discuss the role of experts in the Swedish legislative process, focusing on the legitimizing function they can have as part of government committees. The example used is the committee whose inquiry led to a law reform in 1998 which focused on domestic violence; “Gross Violation of a Woman’s Integrity”.

    Abstract [en]

    Between the years 1898-1925 there was an intense debate in the Swedish Parliament concerning different legislative proposals on the right for conscientious objectors to be exempted from military service. In 1902 a royal ordinance gave the regimental commander an option to allow conscripts, who professed grave compunctions regarding military service, to perform other work within the regiment. In 1920 a provisional law was passed that gave religious conscientious objectors the opportunity to serve outside the regiment and in civilian clothing and in 1925 the law was made permanent.

    The main purpose of this study has been to determine how the concept of protection due to freedom of consciousness was used in this context and how the limits of this protection was perceived and constructed in the parliamentary debate and in legislative proposals.

    The debate regarding legal protection for conscientious objection have also been analysed from a gender perspective, with an aim to illustrate how different perceptions of masculinity and masculine behaviour collided in this debate. The conscientious objectors were regarded by some as being honourable and principled, but were by others seen as cowards who did not understand that it was their duty, as men, to learn how to protect their country, a duty which was greater than any need for freedom of consciousness.

    The study shows that the issue of legislative protection for conscientious objection was debated in a context where the emphasis was on the state interest as the primary objective. When it came to conscientious objection, freedom of consciousness was allowed only as long as it did not interfere with the state’s interests. In the first years of the period, the limitations on freedom of consciousness were very strict. In 1925, with conscientious objection being defined in a religious, as well as an ethical context, freedom of consciousness was given more leeway, but was still limited to what was in accordance with the state interests. The focus was on the individual’s duties and obligations towards the state. It was a matter of civic duties, rather than of civil rights.

    Twenty years ago, the Swedish National Council for Crime Prevention presented a report that highlighted serious problems with regard to identifying, investigating, and sentencing offenders for hate crimes. The same problems have also been described in international research from several other countries. Since then, several measures have been taken to remedy these problems, but it remains unknown whether these measures have been successful. The aim of the present study is therefore to trace developments over time, using Sweden as a case study, and to evaluate the extent to which the problems identified earlier have been remedied. The results show that the problems identified by the Swedish National Council for Crime Prevention still remain despite a continuous process of reform. Theoretical links and parallels to international research are discussed throughout the article.

    Som en del i uppmärksammandet av Umeås 400-årsjubileum arrangerade juridiska institutionen, tillsammans med Umeå kammarmusikförening, den 31 maj 2022 en rättshistorisk afton på hovrätten.  Fanny Holm från juridiska institutionen var en av initiativtagarna och berättar här tillsammans med sin kollega Görel Granström vad som hände när man väckte liv i en rättegång från år 1676 där pigan Karin anklagades för häxeri.
