To have one?s day in court. An investigation into the legal standing of crime victims in criminal procedure.There is a need for a better understanding of the rules regulating the crime victim?s right to participate in the trial in the form of addressing the court. At the moment, different rules may apply in different cases and different court rooms. A better understanding of the historical background, combined with a comparative analysis of ways of regulating participation could be an aid in proposing the direction the Swedish courts should take, and a way of furthering the participation of crime victims in criminal procedures. The purpose of this project is therefore to answer the following question: Has there, during the last ten years, been a change in legal practice (praxis) regarding the possibility for Swedish crime victims to make their voices heard in court? Is it a paradigmatic shift or a natural consequence of the historically strong position of the Swedish crime victim as an injured party? Can examples from other legal traditions be used? And last but not least; Is there a risk of allowing demands for retaliation or is there, instead, a possibility to achieve a greater understanding of what victimization entails? The methods used in this study will be primarily those used within legal scholarship, especially comparative legal history, e.g. textual analysis of a variety of legal documents, such as legislation, preparatory works, case law and legal research.
